1. Acceptance of Terms

Welcome to Scribe. By accessing or using our mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Scribe ("we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Eligibility and Account Requirements

2.1 Age Requirements

• The App is intended for users aged 13 and older
• Users under 13 must have verifiable parental consent to use the App in compliance with COPPA
• By using the App, you represent that you meet these age requirements or have obtained parental consent

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during onboarding and to update this information as necessary. You are responsible for maintaining the confidentiality of your account credentials.

3. Subscription Terms

3.1 Subscription Plans

Scribe offers the following subscription options:

• 7-Day Free Trial: Full access to all PRO features
• Monthly Subscription: $9.99/month, billed monthly
• Annual Subscription: $79/year, billed annually (save $40/year)

3.2 Free Trial

• New users receive a 7-day free trial with full PRO access
• The trial automatically converts to a paid subscription unless canceled at least 24 hours before the trial ends
• One free trial per user
• Trial access includes IJS Competitive Mode, GOE tracking, unlimited sessions, and all PRO features

3.3 Billing and Renewal

• Subscriptions are processed through Apple's In-App Purchase system
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID account will be charged upon confirmation of purchase
• Subscriptions automatically renew at the same price unless a price change is communicated in advance

3.4 Cancellation and Refunds

• You can cancel your subscription anytime through your Apple ID subscription settings
• Cancellation takes effect at the end of your current billing period
• No refunds for partial subscription periods
• Refund requests must be submitted through Apple's refund process

4. License and Usage Rights

4.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, redistribute, or resell access to the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Use automated systems (bots, scripts) to access the App
• Remove, obscure, or alter any copyright, trademark, or proprietary notices

5. User Content and Data

5.1 Your Content

You retain ownership of all content you create in the App (training logs, notes, goals, etc.). By using the App, you grant us a license to store, process, and display your content solely to provide the App's services.

5.2 Data Export

You may export your training data at any time through the App's export feature. We are not responsible for data loss if you fail to regularly back up your data.

5.3 Prohibited Content

You agree not to input or store:

• Illegal, harmful, or offensive content
• Content that violates third-party rights (copyright, trademark, privacy)
• Malicious code, viruses, or harmful software
• Sensitive personal information beyond what is necessary for training tracking

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Results obtained from the App will be accurate or reliable
• The App will meet your specific requirements
• Any errors or defects will be corrected

Important: Scribe is a training tracking tool, not a coaching or medical device. Consult qualified coaches and medical professionals for skating instruction and injury prevention.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRIBE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Scribe and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the App

9. Third-Party Services

The App uses third-party services (Supabase, Apple In-App Purchase) that have their own terms and privacy policies. We are not responsible for the practices of these third parties.

10. Termination

10.1 By You

You may terminate your account at any time by contacting us at support@scribeskate.com or through the App's settings.

10.2 By Us

We may suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Any other reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

11. Intellectual Property

The App, including all content, features, functionality, software, and design, is owned by Scribe and protected by copyright, trademark, and other intellectual property laws. The Scribe name, logo, and all related marks are trademarks of Scribe.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which Scribe is registered, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
